Terms of Service

Please read these terms carefully before using BitQate’s hosting services. By using our platform you agree to be bound by them.

1. Service Terms

  • BitQate provides web hosting and game server hosting services with RAM BURST technology.
  • By using our services, you agree to these terms and conditions.
  • We reserve the right to modify these terms with 30 days' notice via email.
  • Users must be at least 18 years old, or have verifiable parental or guardian consent.
  • Each account must be associated with a valid email address and payment method.

2. Credit-Based Billing & RAM Burst

Services are billed using credits charged per minute based on the resources you allocate.

Credit packages
Topped up monthly: Starter ($10), Professional ($25), and Enterprise ($50). Credits in your balance never expire.
Resource rates
Credits are consumed only for resources you actively allocate — RAM ($0.44/GB/mo), CPU ($1.38/core/mo), Drive ($0.025/GB/mo), and IPv4 ($1.50/mo).
RAM Burst
Activates automatically when your server requires additional memory beyond its normal allocation. Burst capacity is not guaranteed and is subject to host availability.

3. Service Level Agreement

  • We work to maintain high availability for all hosting services.
  • Scheduled maintenance will be announced at least 48 hours in advance.
  • DDoS protection is included in all hosting plans.
  • Network latency is monitored and optimised continuously.

4. Acceptable Use

You are responsible for all activity on your account. The following are prohibited on BitQate infrastructure:

  • Cryptocurrency mining or any resource-intensive proof-of-work activity.
  • Botting, credential stuffing, or automated scripts that strain shared resources.
  • Hosting malicious content, malware, ransomware, or phishing pages.
  • Launching or facilitating DDoS attacks or network abuse of any kind.
  • Hosting or distributing content that is illegal in your jurisdiction or ours.
  • Reselling or subdividing allocated resources to third parties.
  • Hosting, deploying, or distributing sexually explicit content or material.

Resource usage must not consistently exceed your plan limits. Full details are set out in our Acceptable Use Policy.

5. Payment Terms

  • All prices are in USD and billed as monthly credit subscriptions.
  • Credits are deposited to your balance at the start of each billing cycle.
  • Credits already added to your balance are non-refundable but never expire and remain available until depleted.
  • Service is automatically suspended after 3 days of payment failure.
  • Data is retained for 30 days after service suspension before permanent deletion.

6. Data Protection

We implement technical and organisational measures to protect your data:

  • End-to-end encryption for data in transit (TLS/HTTPS).
  • Regular security audits and access controls.
  • Automated backup infrastructure for platform resilience.

Users can create manual backups of their server at any time via the control panel. Backups are stored as compressed archives and count towards storage allocation. Users maintain full ownership of their hosted content. Personal information is handled as per our Privacy Policy.

7. Service Termination

We may terminate service immediately for:

  • Violation of these terms or our Acceptable Use Policy.
  • Non-payment after the grace period.
  • Fraudulent or deceptive activity.

Users may cancel their subscription at any time with no further charges. Credits already added to your balance are non-refundable but never expire. Data is permanently deleted 30 days after termination.

8. Limitation of Liability

BitQate provides services on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all implied warranties and limit our liability to the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental losses.

9. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
